Terms of Service

These terms define the rules for accessing and using Kibie's websites, workspace, assessments, integrations, and related services.

Agreement to these terms

These Terms of Service ("Terms") govern access to Kibie.ai websites, the Kibie workspace, assessments, reports, integrations, and related services (collectively, the "Services"). By using the Services, you agree to these Terms. If you use the Services for an organization, you confirm that you have authority to bind that organization, and "you" includes the organization. A signed order form or services agreement controls if it expressly conflicts with these Terms.

Eligibility and accounts

You must be legally able to enter into a binding agreement and use the Services for legitimate business purposes. You are responsible for accurate account information, safeguarding credentials, assigning appropriate access, and all activity under your account. Notify us at support@kibie.ai if you suspect unauthorized access.

The Services

Kibie helps businesses assess visibility in AI and search experiences, organize buyer questions and business facts, plan and produce content, track publication evidence, and measure outcomes. We may update the Services over time. Specific deliverables, service levels, usage limits, and commercial commitments are those stated in an applicable order form or written agreement.

Customer data and permissions

You retain ownership of information, materials, domains, instructions, and content you submit to the Services ("Customer Data"). You grant Kibie a limited right to host, copy, process, transmit, and display Customer Data only as needed to provide, secure, support, and improve the Services and meet our legal obligations.

You represent that you have all rights and permissions needed for Customer Data and for any website, account, data source, or third-party service you ask us to access. You are responsible for accuracy and legality and for reviewing deliverables before external use or publication.

Third-party services and integrations

The Services may connect to Google Search Console, AI engines, search providers, publishing channels, storage providers, and other third-party services. Your use of a third-party service remains subject to that provider's terms and policies. You authorize Kibie to exchange data with a connected service as needed to perform the feature you request. We are not responsible for third-party availability, changes, suspension, data accuracy, or acts outside our control.

Acceptable use

You may not use the Services to:

  • violate law, third-party rights, platform rules, or contractual restrictions;
  • submit malicious code, interfere with security, probe vulnerabilities, or disrupt the Services;
  • access another customer's data or impersonate a person or organization;
  • send spam, manipulate reviews or public discourse, misrepresent evidence, or publish deceptive claims;
  • reverse engineer or copy the Services except where applicable law expressly permits it; or
  • use automated means in a way that exceeds documented limits or materially burdens the Services.

AI, search, and analytics limitations

AI responses, search results, rankings, citations, and third-party metrics change over time and may be incomplete or inaccurate. Kibie provides evidence, analysis, and workflow support, not a guarantee of any ranking, citation, recommendation, traffic level, revenue result, or publication outcome. You must review generated content, recommendations, and factual claims before relying on or publishing them. The Services do not provide legal, tax, financial, or regulated professional advice.

Fees and payment

If you purchase paid Services, fees, billing intervals, taxes, payment dates, and renewal terms are stated in your order form or other purchasing document. Unless that document says otherwise, fees are non-refundable except where required by law, and you are responsible for applicable taxes other than taxes based on Kibie's income.

Intellectual property

Kibie and its licensors retain all rights in the Services, software, interfaces, methods, templates, documentation, and branding. Subject to payment and any order-form restrictions, you may use deliverables created specifically for you for internal business and approved external publishing purposes. Pre-existing materials, platform technology, general know-how, and aggregated or de-identified learnings remain with their respective owners. If you provide feedback, you permit us to use it without restriction or payment.

Confidentiality and privacy

Each party will use reasonable care to protect non-public information disclosed by the other and will use it only for this relationship. This obligation does not apply to information that is public through no breach, already lawfully known, independently developed, or rightfully received from another source. Our handling of personal information is described in the Privacy Policy.

Suspension and termination

You may stop using the Services at any time, subject to any active order form. We may suspend access when reasonably necessary to address a security risk, unlawful use, non-payment, harm to other users, or a material breach. Either party may terminate as allowed by an applicable order form or law. On termination, your right to use the Services ends, but provisions that by their nature should survive will remain effective.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." Kibie disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation or that third-party data, AI output, or search results will be accurate, complete, or remain available.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, even if advised of the possibility. Kibie's total liability arising from the Services will not exceed the amount you paid for the affected Services during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.

General terms

The governing law, courts, and dispute process identified in an applicable order form or signed agreement apply. If none is identified, applicable conflict-of-law rules determine the governing law and forum. Neither party is liable for delay caused by events beyond reasonable control. You may not assign these Terms without our consent except as part of a merger or sale of substantially all relevant assets. If a provision is unenforceable, the remaining provisions remain effective. These Terms and applicable order forms are the complete agreement concerning the Services.

Changes to these terms

We may update these Terms to reflect changes to the Services, law, or business practices. We will post the updated version and revise the effective date. If changes materially affect an active paid service, we will provide additional notice where required. Continued use after the effective date constitutes acceptance of the updated Terms.
